Maternity leave

In France, since 1909, any pregnant employee has the right to maternity leave, provided that she first informs her employer. It is a suspension of the employment contract.
The duration of this leave varies according to the number of children whose employee or household already assumes the load at the time of birth.

Length of maternity leave

The day of delivery is included in the postnatal period and is the starting point.
There are two types of maternity leave periods in France: compulsory duration and legal duration.

> Compulsory duration: 8 weeks (2 weeks before the expected date of delivery + 6 weeks after). Failure to comply with this compulsory maternity leave would entail penalties.

Birth or adoption of the first or second child:
> Legal duration of maternity leave: 16 weeks (6 weeks before delivery + 10 weeks after), for first and second births.
> Adoption leave: The mother or father who adopts a child has the right to suspend his employment contract for a period of not more than 6 weeks from the arrival of the child at home.

Birth or adoption of a child from the third:
> Legal duration of maternity leave: 26 weeks (8 weeks before delivery + 18 weeks after). Prenatal leave can be increased by 2 weeks, but postnatal leave will be reduced accordingly.
> Adoption leave: The mother or father who adopts a child has the right to suspend his employment contract for a period of 18 weeks at the most, from the arrival of the child to the home.

Multiple birth or adoption:
> Legal duration of maternity leave for twins: 34 weeks (12 weeks before delivery and 22 weeks after). Prenatal leave can be increased by 4 weeks, but postnatal leave will be reduced accordingly.
> Statutory duration of maternity leave for triplets and more: 46 weeks (24 weeks before delivery and 22 weeks after).
Adoption leave : In the case of multiple adoption, the duration corresponds to the post-natal leave of 22 weeks.
